Appeals Court Rejects TED NUGENT's Suit Over Canceled Concert

Jack Kresnak of the Detroit Free Press reports: The Michigan Court of Appeals has upheld a lower court's rejection of lawsuits filed by rock artist and hunting enthusiast Ted Nugent against Muskegon Summer Celebration after the MSC canceled a 2003 AMBOY DUKES concert because of comments on race made at that time by the musician.

After Nugent's comments in a radio interview were published in the Muskegon Chronicle that quoted some people saying they were racially offensive, the MSC said announced cancellation of the June 30, 2003, show by saying in a news release that "any use of potentially offensive racial terms such as those attributed recently to Ted Nugent do not reflect the spirit of Muskegon nor the Summer Celebration."

The MSC made no further comments about Nugent's remarks.

Nugent and his band sued the MSC for libel, slander, breach of contract, "detrimental reliance," unfair competition and unjust enrichment. But a Muskegon County Circuit Court judge dismissed all allegations except breach of contract, which was heard by a jury.
