Report: Concert Injuries Land Promoters, Venues In Court
June 7, 2008James Paton of Denver, Colorado's The Rocky Mountain News reports: Nicole LaScalia was knocked to the floor of Magness Arena and trampled by concertgoers moments after the heavy metal band MUDVAYNE took the stage.
The Thornton waitress had gone to the KBPI-FM (106.7) "Birthday Bash" on March 8, 2006, eager to see MUDVAYNE and KORN.
She left in an ambulance, her leg crushed.
Those details emerged two years later in a lawsuit LaScalia filed against radio station owner Clear Channel Broadcasting, concert promoter Live Nation and the University of Denver, the site of the concert. She also sued members of the bands.
Injuries continue to pose legal problems for the businesses that host and promote rowdy shows and raise questions about who is responsible. Many cases involve festival seating or general admission areas.
LaScalia, 27, had surgery after fracturing her tibia and fibula and badly hurting her ankle, said her lawyer, Darrell Elliott. She also had about $60,000 in medical bills and "severe pain and suffering," he said.
LaScalia, who worked at Parkway Cafe in Federal Heights, fell to the ground as MUDVAYNE began playing and fans surged toward the stage, the lawsuit stated. KORN had yet to appear.
